In a statement made on The Kansspelautoriteit (the Ksa, Netherlands gambling authority) website, the regulator has released further information on the upcoming igaming licenses to prepare applicants for the licensing process. 

Although online games of chance are currently prohibited in the Netherlands, this will change once the Remote Gambling Act (Wet Kansspelen op afstand) comes into effect. Despite the fact that the exact date on which the Act will enter into force is unknown, the Netherlands is set to open a regulated online gambling market in January 2021 and aims to bring secondary regulations governing the market into force from 1 July 2020. Licenses can be applied as soon as the legislation enters into force.

The application for the license will cost €45,000 and if not granted, applicants will not receive a refund. All applications must be written in the Dutch language and a translation into Dutch must be included with all other official documents. 

The license will be granted only in the cases where they are fully completed, the identity of the applicant is clear, payment has been made, the operator is able to offer its services in a responsible, reliable and verifiable matter and a policy plan setting out how the operator will ensure its employees have appropriate knowledge of the Netherlands’ gambling laws and regulations is submitted. 

Operators applying for the License must also not have been declared bankrupt in the past, have suspended payments or had assets seized and take appropriate measures to ensure that the players’ funds are separate from working capital. 

Additional guidelines were given regarding marketing strategies, strategies to combat gambling addiction and compliance with Dutch consumer protection laws and the Terrorist Financing Act.

Russian affiliate Bookmaker-Ratings published a user survey in which shows that 14.6% of Russian users are betting on a monthly basis, 42.4% of them bet every week and 35.8% wagered every day.

Although 68.2% of these users bet exclusively on Russian-licensed operators and only 8.3% only choose international sites, the average monthly spending with international betting sites was 255 EUR, nearly twice the amount that bettors wagered with Russian-licensed sites – 120 EUR.

During this week, the Russian media outlet Kommersant published the results of a Sberbank survey on the nation’s sports bettors. The survey revealed that the overall betting market will grow at an annual rate of 7% per year through 2020. Over this same period of time, the annual growth in Russian-licensed online bookmakers will hit 30%.

Svetlana Sukhanova, Sberbank analyst, said that this online growth will not necessarily come from an increase in the number of bettors but the belief is that Russia’s online bettors will increasingly transfer their wagering from internationally licensed operators to locally licensed sites.

As the cost of operating in the UK has risen significantly in recent years, Betclic has joined the group of companies who decided to leave the very competitive UK online gambling market. 

The French online gambling operator announced to affiliates and UK customers that they will be pulling all of their Betclic Group brands – including Betclic, Everest and Expekt – from the market effective October 31. All customers must withdraw the funds from their accounts until the 6th of December and deposits are no longer possible. 

The operator explained that the reason behind their decision was the “very competitive market” and that their brands have suffered from “low performance”. According to eGaming Review, Betclic’s overall performance is not suffering as the operator’s revenue in the 12 months ending June 30 had risen 27% and earnings were up 39%. 

We will just have to wait and see how many other companies will Brexit before Boris Johnson does.

The Spelinspektionen, Sweden’s gambling regulator, has decided not to punish four of its licensees (Betsson, Bet365, AB Trav Och Galopp (ATG), Spooniker) after concluding that they haven’t actually violated any rules on accepting wagers on matches involving underage athletes.

In late April, the Spelinspektionen issued a warning to some of its licensees who had offered in-play bets on the performance of individual athletes, among them athletes under the age of 18. A few months later, in July, they lowered the boom on eight licensees, including Bet365’s Hillside Sports offshoot, which was ordered to pay a penalty of SEK10m (1k EUR).

After closer inspection, the regulator announced that since the players involved “were largely over 18 years”, the investigation on the four operators could be dropped. Nevertheless, it’s yet unclear from the regulator’s announcement whether they will continue to conduct investigations on other licensees as warnings were given to four more in August.

The confusion over what is and isn’t permissible convinced Gaming Innovation Group to shut its Swedish-licensed sportsbook in July. In May 2018, Spelinspektionen (under its previous Lotteriinspektionen identity), followed warnings sent to 39 online media outlets to stop running ads for internationally licensed gambling sites within 24 hours or face the consequences. The Swedish media scored a legal victory this week after an appeals court ruled that they didn’t have to pay fines for running ads for unauthorized gambling operators.

Taking into consideration the UK’s upcoming Exit from the European Union, the Malta Gaming Authority (MGA) is turning its attention on the possible impact and is publishing a guidance note. 

The contents of the document relate only to regulatory affairs within the remit of the MGA. Operators should be aware of ulterior consequences resulting from Brexit, including but not limited to data protection, immigration, employment, duty, and copyright considerations.

As per their official statement, the guidance note is of particular importance to entities established in Malta and operating in the United Kingdom, or entities established in the United Kingdom providing services and supplies within Malta, and it also details transitory measures in place for operators to ensure readiness and avoid regulatory disruption.

Last week, the Italian media have announced that in the Italian Goverment’s fiscal budget for 2020 is including a tax rise on large lottery jackpots from 12% to 23%.

Gamblers’ winnings under €500 will be taxed with 12%. The new tax regime will be applied to all kinds of gambling, from lotteries to sports bets. A variable rate will be escalated along with the value of winnings. The Italian gaming operators are struggling for impact after the proposed further tax increases. 

Laura Castelli, Deputy Minister for the Economy, said last week that the government’s “virtuous” fight against gambling would continue to “move forward, not backwards.”

Giorgio Pastorino, President of local gaming industry association STS, claimed that the plan would benefit only large banks and financial institution.

Pastorino characterized Castelli’s comments as “a lack of competence on the subject.” and wondered if Castelli thought if a punter would be interested in using a card to play a €1 game or make a small wager, while also claiming that operators would be unwilling to accept a card for such a low amount, considering the percentage of each payment stated by the card issuer.
